Terms of Service

1. Acceptance of Terms

By downloading, installing, or using 888 App ("the App"), you agree to be bound by these Terms of Service ("Terms"). This is a legal agreement between you and 888 App ("we," "us," or "our"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

2. Description of Service

888 App is a video diary application that allows users to:

• Record short video clips (up to 8 seconds) daily.
• Organize videos using a calendar-based interface.
• Add emotions, tags, and metadata to video clips.
• Create video mashups and reels from recorded clips.
• Manage multiple projects for different purposes.
• Export videos in various quality formats.

All content created using the App is stored locally on your device. We do not provide cloud storage or synchronization services.

3. User Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18 years of age, you represent that you have obtained parental or guardian consent to use the App.

4. User Account

The App does not require user registration or account creation. All data and content are stored locally on your device. You are solely responsible for maintaining the security of your device and the content stored on it.

5. User Content

You retain all rights to the content you create using the App ("User Content"). By using the App, you acknowledge that:

• You are solely responsible for all User Content you create, store, or share.
• You will not use the App to create, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• You will not use the App to infringe upon the intellectual property rights of others.
• You will not record or photograph individuals without their consent where required by law.

We do not monitor, review, or have access to your User Content. You are solely responsible for backing up your content.

6. Intellectual Property

The App, including its design, features, functionality, and content (excluding User Content), is owned by 888 App and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, or distribute the App or any portion thereof.
• Reverse engineer, decompile, or disassemble the App.
• Remove any copyright or proprietary notices from the App.
• Use the App for any commercial purpose without our written consent.

7. Prohibited Uses

You agree not to use the App to:

• Violate any applicable laws or regulations.
• Infringe upon the rights of others, including privacy and intellectual property rights.
• Transmit any viruses, malware, or other harmful code.
• Interfere with or disrupt the App or servers connected to the App.
• Attempt to gain unauthorized access to any portion of the App.
• Use the App in any manner that could damage, disable, or impair the App.
• Use automated systems or software to extract data from the App.

8. Third-Party Services

The App may integrate with or provide links to third-party services, including analytics providers and advertising networks. Your use of such third-party services is governed by their respective terms of service and privacy policies. We are not responsible for the content, functionality, or practices of any third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• WARRANTIES THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT.

You acknowledge that your use of the App is at your sole risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 888 APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or content.
• Loss of profits, revenue, or business opportunities.
• Personal injury or property damage.
• Any damages arising from your use or inability to use the App.

Our total liability to you for any claims arising from or related to the App shall not exceed the amount you paid for the App, if any.

11. Indemnification

You agree to indemnify, defend, and hold harmless 888 App and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any rights of another person or entity.
• Your User Content.

12. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which 888 App is established, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the App shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 888 App regarding the App and supersede all prior agreements and understandings.
